FULL GIFT CARD AND E-GIFT CARD TERMS AND CONDITIONS

1. By purchasing, redeeming, or attempting to redeem a Celebrity
Ink™ gift card or e-gift card (jointly “Gift Card”), you accept the full terms and
conditions.

2. Gift Cards expire 36-months from the date of purchase.

3. Gift Cards cannot be replaced, refunded, or redeemed if damaged, altered, lost or stolen.

4. Gift Cards, once activated, may only be used for purchases at Celebrity Ink™ Studios in the country of issue.

5. Gift Cards cannot be returned or exchanged for cash or credit under any circumstances whatsoever.

6. The Gift Card cannot be redeemed via email, phone or facsimile.

7. The Gift Card must be physically presented to the Celebrity
Ink™ Studio at the time of redemption Photos of Gift Cards will not be accepted.

8. No change is given and any balance that remains on the Gift Card can only be used in wholeor part
against future purchases.

9. Gift Cards are void and not redeemable after the expiry date, except as required by law.

10. Gift Cards cannot be reloaded.

11. No refunds will be given for any Gift Card purchases.

12. Not redeemable against other Gift Cards or any other stored value card.

13. Purchases exceeding available balance require the difference to be paid by another method.

14. The holder of the Gift Card is responsible for the use and safety of the Gift Card and all transactions undertaken by use of the Gift Card at all relevant times.

15. To the extent permitted by law Celebrity Ink™, its franchisees and all related and associated entities of Celebrity Ink™ and its franchisees:

1. 1. • are not liable to any person for any loss or damage, including direct, indirect or consequential loss, arising out of any use or attempted use of the Gift Card; and
      • will not be in default of these terms and conditions for failure to observe or perform any obligation under these terms and conditions for any reason or cause which could not, with reasonable diligence, be controlled or prevented.

16. Nothing under these terms and conditions is intended to exclude or modify any non-excludable statutory rights under Schedule 2 of the Competition and Consumer Act 2010 (Cth), Australian Securities and Investments Commission Act 2001 (Cth) or any other law.

17. The Gift Cards are the intellectual property of Celebrity Ink™ and remain the intellectual property of Celebrity Ink™ under all circumstances.

18. The Gift Cards remain the property of Celebrity Ink™ and must not be re-sold to any other person.

19. These terms and conditions maybe amended from time to time.

Gift Vouchers

• Gift Vouchers are single use and redeemable for product and services at ant Celebrity Ink™ Studio (unless otherwise stated).
• Gift Voucher cannot be used in conjunction with any other offer.

• No change will be given if full Gift Voucher amount is not used, however, unused value will remain available until the date of the Gift Voucher expires.
• Gift Voucher is valid three (3) years from issue.

• No refunds will be given for any gift voucher purchased.

• The Late Night Trading Campaign ("the Campaign") is organized by Celebrity Ink™ Surfers Paradise and is valid for a limited time only. The Campaign allows customers to receive a $100 discount on their tattoo when they book an appointment between 4:00 PM and 8:00 PM.
• The $100 discount is applicable only to tattoo services provided by Celebrity Ink™ Surfers Paradise and cannot be used in conjunction with any other offer, promotion, or discount.
• The $100 discount is non-transferable and cannot be exchanged for cash or credit. It can only be applied towards the cost of the tattoo service.

Complimentary tattoo touch up terms & conditions

Due to the individuality of tattoos and how they react with different skin, touch ups may be required from time to time. A touch up appointment is designed to repair small discrepancies including minor ink drop out and colour fading. A complimentary touch up is available at all Celebrity Ink™ studios around the world. This does not apply to Cosmetic Tattoo procedures.

Terms & Conditions:

• The complimentary touch up is available to be redeemed within 3-months of your original tattoo date.
• After the 3-month expiry, all touch up appointments will be quoted and charged at the standard rate.
• The complimentary touch up can only be redeemed at the original studio location and cannot be transferred to another studio location or person.
• The complimentary touch up appointment is only valid for the original tattoo and cannot be transferred to another tattoo location on your body.
• The complimentary touch up appointment must be completed by the original artist. If the artist is not available, an alternative artist will be appointed, at the studio’s discretion.
• Failure to follow correct aftercare instructions will void your complimentary touch up appointment.
• The complimentary touch up appointment is only valid for discrepancies that are not subjective in nature.
• Celebrity Ink™ studios reserve the right to refuse a complimentary touch up for a client if it is deemed that the aftercare criteria have not been met or if it is not suitable. The level of touch up required is at the sole discretion of the original studio.
• The below areas are not eligible for the complimentary touch up:
  • Hands
  • Fingers
  • Feet
  • Toes
  • Neck
  • Face (non-cosmetic)
  • Lip (non-cosmetic)
  • Elbow
• Touch ups are not applicable to cosmetic tattoo services.

BOOKING, CANCELLATION & REFUNDS POLICY

We ask all new clients to complete a Client Registration Form to gather relevant information about you and assess your suitability for tattoo services.

We collect personal information, such as your name, address, contact number and email addresses. This information is used to keep you up to date with Celebrity Ink™ services and developments, confirm your bookings and to provide you with important aftercare information. Please notify the studio of any changes to your contact details including name changes, address, mobile numbers and email. This will help the studio to get any necessary or important information to you.

We collect, store and use all personal information in accordance with the Privacy Act 1988 (Cth). Should you require any further information on the methods we use to collect, store and use personal information, please contact one of our representatives.

BOOKINGS POLICY

1. Bookings can be made by the following methods:

• Online
• In person at any Celebrity Ink™ Studio
• Via telephone by calling your local Celebrity Ink™ Studio

2. To secure your booking a minimum deposit 20% of the service value will be required.

3. We do try to keep on time. Please arrive at the studio 5 to 10 minutes before your booking start time to allow time for parking and checking in. If you are late, we may not be able to provide the full service you have been booked in for.

4. Due to Studio scheduling, there may be a need to alter the start time of your booking from time to time at our absolute discretion.

Please follow all pre and post care instructions to ensure we can successfully complete your service. If you attend your appointment incorrectly prepared and we are unable to complete the service, the studio has the right to forfeit your deposit, or charge for any works completed prior or during your session.

CANCELLATION POLICY

We require a minimum of 48 hours’ notice for any appointment cancellation to allow time to reallocate your appointment to another client. If you cancel within 48 hours of your appointment or fail to attend, you will forfeit your deposit amount.

Should the studio cancel or reschedule your appointment, no fees will be charged to you.

If you are showing any symptoms of COVID-19 or signs of illness, you must reschedule your appointment and stay at home. Clients that do not comply with mandatory requirements to maintain a COVID-19 safe environment may be asked to reschedule on arrival.

REFUNDS POLICY

We are not required to provide a refund if you change your mind about the products or services you received or if you fail to clearly explain your needs before commencement.

Provided we are lawfully entitled to do so in the relevant jurisdiction, we reserve the right to not grant you a refund for any merchandise, jewellery, or services you have purchased at any Celebrity Ink™ Studio.

Unless your booking is cancelled or rescheduled all deposits paid are non-refundable, however subject to the Cancellations Policy, you may exchange/transfer your deposit for a gift voucher or merchandise.

• The promoter is Celebrity Ink™ Tattoo Franchising Pty Ltd (ACN 623 286 322) of SP066 2 Cavill Avenue, Surfers Paradise, Qld 4217 (Promoter).

• The promotion commences at 9:00am Australian Eastern Standard Time (AEST) on 20/02/2023 and closes at 11.59pm AEST 08/03/2023 (Promotion Period).

• Subject to clause 4, Australian Residents who are 18 years and over and have been directly invited via email to complete the survey are eligible to enter.

• Employees, contractors and/or associates of the Promoter (and its related entities), their immediate families and their associated agencies and companies are ineligible to enter.

• To be eligible to enter the draw an entrant must:
  1. Complete the survey in full and submit it to the promoter within the promotion period outlined in Clause 2; and
  2. Provide their contact name, email and phone number to the promoter as outlined in the survey.

• Entries must be received during the Promotion Period. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken by the promotor for lost, late or misdirected entries.

• Entry is limited to 1 per person and multiple entries will be deemed invalid.

• 10 winners will win a $100 Visa Gift Card valued at AU$100 each and having the total prize pool valued at AU$1,000 (Prize).

• Unless otherwise agreed, the promotor will send the prize via email to the winner.

• The Promoter does not accept any responsibility for any failure to receive any entry or for late, lost, or misdirected entries or for inaccurate information or any loss, damage, or injury as a result of technical or telecommunications problems, including security breaches even to the extent that such failure, loss, damage, or injury may be caused by the negligence of the Promotor. If such problems arise, then the Promoter may (where necessary) modify, cancel, terminate, or suspend the Promotion, subject to directions from the regulatory authority.

• Prize winners are guaranteed to be drawn randomly from all eligible entries received. Odds of winner are based on the actual number of entries received and skill plays no part in determining the winner.

• The Promoter’s decision is final, and no correspondence will be entered into regarding the result.

• If there are no eligible entries no draw will be conducted, and no Prize will be awarded.

• The winners will be selected at random on 09/03/2023 and notified via email no later than 5 days after the promotion period. Winners must claim the prize within 7 days of notification. If a winner does not respond within the specified time frame they will forfeit their prize and the promotor reserves the right to draw another winner.

• The Promoter reserves the right to disqualify any entrant or winner and may refuse to award any Prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Promotion, or obtained winner status using fraudulent means.

• If due to any reason whatsoever Promoter becomes aware after an entrant has won a Prize that the entrant has not complied with these Terms and Conditions, that entrant will have no entitlement to the Prize, even if Promoter has announced them as a winner and that entrant will be required, at the direction of Promoter, to return, refund or otherwise make restitution of the prize.

• The Promoter accepts no responsibility for incorrectly provided information.

• The Prize must be taken as offered and are not redeemable for cash or an alternative prize. The Prize is not transferable.

• The Promoter reserves the right to request winners to provide proof of identity and verify eligibility to enter this Promotion in order to claim a Prize. Proof of identification considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered.

• The Promoter and each of its related entities, their officers, employees, and agents will not be liable for any loss, damage, or personal injury (including but not limited to indirect or consequential loss) whatsoever that is suffered or sustained in connection with this promotion, the promotion of this promotion or the receipt or use of the Prize, except for any liability which cannot be excluded by law.

• The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant’s or any other person’s computer, or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to the Promotion.

• If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole and absolute discretion to disqualify any individual or entrant who tampers with the entry process, to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion.

• In the event of war, terrorism, pandemic, state of emergency or disaster the Promoter reserves the right (subject to any written directions under applicable law) to cancel, terminate, modify, or suspend this promotion.

• The Promoter will not be responsible for any incorrect, inaccurate, or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation, technical malfunctions, or failures.

• An entry and any copyright subsisting in an entry into this Promotion irrevocably becomes, at the time of entry, the property of the Promoter.

• The Promoter collects personal information about an entrant to include the entrant in the Promotion and where appropriate award the Prize(s). If the personal information requested is not provided, the entrant cannot participate in the Promotion. By entering the Promotion and opting in, an entrant agrees that the Promoter may use the entrant’s personal information in the manner set out in this condition. An entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant State or Territory lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter. All personal information will be stored at both the Celebrity Ink™ studio and/or the offices of the Promoter at the address above. VIP Room Promotion 2023 Entry Conditions

1. The promoter is Celebrity Ink Tattoo Franchising Pty Ltd ACN 623 286 322, C/- Level 15, 66 Eagle Street, Brisbane QLD 4000 (Promoter).

2. The promotion commences at 12.00 pm Australian Eastern Standard Time (AEST) on 4th April and closes at 11:59 pm AEST on 18th April (Promotion Period).

3. Subject to clause 4, the promotion is open to Australian residents who are aged 18 years and over only.

4. Employees, contractors and/or associates of the Promoter (and its related entities), their immediate families and their associated agencies and companies are ineligible to enter.

5.  To be eligible to enter the draw you must:

If you do not respond within the specified time frame you will forfeit your Prize and the Promoter reserves the right to select another winner. The Promoter also reserves the right to select another winner in the event that you are ineligible for entry to this promotion.

14. The Promoter accepts no responsibility for incorrectly provided information.

15. Three winners will win a prize as set out in the below, being a total of 3 prizes and having the total prize pool valued at AU$2,370. (Prize):

• Upgrading your service to the ‘Half Day DUO VIP Experience’ package is charged at $160 and can not be altered or changed based on needed inclusions. It is available for two people only who both book a half day tattoo session. This cost is in addition to the cost of two quoted half day tattoo sessions and is a one-off requirement. Tattoo session costs may vary based on colour, size, complexity, location and artist.
• The upgrade must be taken in conjunction with two half day tattoo bookings. Half Day bookings are scheduled either in the morning or afternoon and subject to date and time availability. Half Day bookings are for a maximum of 3.5 hours, including breaks and both people must take their tattoo session at the same time.
• The ‘Half Day DUO VIP Tattoo Experience’ upgrade must be paid in full at time of booking, plus a minimum 20% deposit against both half day tattoos and is subject to our booking, cancellation and refund policy.
• Bonus merchandise may change by style and size and is subject to availability. Merchandise can not be exchanged for cash or credit.
• Free Celebrity Ink™ star logo tattoo is for a maximum size of 5cm x 5cm and is of a Celebrity Ink™ star logo only. Free tattoo can not be changed for another design or redeemed for cash or credit.
• Unlimited snacks and drinks are available only to the clients receiving the tattoo and not available to any accompanying guests.
• Unlimited snacks and drinks are to be consumed within the room only. Extras can not be taken with either client before, during or after the tattoo session. Every attempt will be made to accommodate dietary requirements and allergies, however, are subject to availability.
• A TV screen will be provided to stream movies to from your personal device. Without your own personal device and access to a streaming service, this service will be unavailable. This service is shared when booking the DUO Experience.
• A maximum of one guest each can attend your VIP tattoo experience and is subject to space restrictions by studio location. All guests must respect other clients and our artists at all times. Any disturbances will result in guests being asked to leave. Guests gain access only to the VIP room and can not share in the extras provided.
• No part of the experience can be exchanged for discount, cash or credit and must be taken as per current studio availability and as outlined within the terms and conditions.
• Where a merchandise or aftercare product is out of stock or unavailable, an alternative product will be provided to an equal or higher amount at the discretion of the studio.

Terms and Conditions for "Celebrate Your Bestie This Friendship Day" Campaign at Celebrity Ink™ Tattoo Studio

Eligibility:

1.1. The "Celebrate Your Bestie This Friendship Day" campaign is open to individuals aged 18 years and above.

1.2. $50 voucher available at select Australian Celebrity Ink™ Studios only (excludes Ipswich).

1.3 Eligible for tattoo services with a minimum spend of $200.

Campaign Period:

2.1. The "Celebrate Your Bestie This Friendship Day" campaign will start on July 30th.

2.2. Limited time only. Subject to change and cancellation at any time.

Offer Details:

3.1. The "Celebrate Your Bestie This Friendship Day" campaign offers $100 off on tattoo sessions for two customers being $50 off for each customer.

3.2. To avail of the offer, a minimum of two (2) people must book their tattoo sessions together from July 30th.

3.3. Both participants must receive their tattoos on the same day to be eligible for the 100% off promotion.

Booking Procedure:

4.1. Participants must contact Celebrity Ink™ Tattoo Studio to schedule their tattoo sessions in advance.

4.2. Tattoo sessions are subject to availability from July 30th and will be allotted on a first-come, first-served basis.

4.3. Participants must mention the "Celebrate Your Bestie This Friendship Day" campaign during booking to qualify for the promotion.

Design Selection:

5.1. Participants can choose their desired tattoo designs, subject to the studio's guidelines and the artist's approval.

5.2. Tattoo design modifications or customizations may incur additional charges, which will be communicated prior to the session.

Refunds and Cancellations:

6.1. The "Celebrate Your Bestie This Friendship Day" campaign is non-transferable and cannot be exchanged for cash or any other alternative.

6.2. Cancellations made by participants may void the promotion, and regular tattoo session rates will apply.

Liability:

7.1. Celebrity Ink™ Tattoo Studio holds no responsibility for any allergic reactions, infections, or complications resulting from the tattoo sessions.

7.2. Participants understand and accept the risks associated with getting a tattoo and release Celebrity Ink™ Tattoo Studio from any liability related to such risks.

Modifications and Termination:

8.1. Celebrity Ink™ Tattoo Studio reserves the right to modify or terminate the "Celebrate Your Bestie This Friendship Day" campaign at any time without prior notice.

Governing Law:

9.1. These terms and conditions are governed by the laws of the region where Celebrity Ink™ Tattoo Studio is located.

9.2. Any disputes arising from or in connection with the campaign shall be subject to the exclusive jurisdiction of the courts in the region.

By participating in the "Celebrate Your Bestie This Friendship Day" campaign, participants indicate their acceptance of these terms and conditions.
